Land Mergers in Boulder County 

MERGER UPDATE

At the BOCC hearing on August 24, 2004, the Boulder County Commissioners unanimously approved the proposed text amendments re mergers despite (or perhaps in spite of) recommendations to reject them from its own advisory committee (the Boulder County Planning Commission), newspapers editorials, letters (nearly 200 were received on this issue), and testimony from merger victims, the Land Use Coalition, and the public. To discuss the ramifications of the commissioners decisions, we will be focusing on this issue at our monthly meeting on Wednesday Sept. 1 at 530 PM at the Rockies Brewing Co. in Boulder. If you are a merger victim, we strongly encourage you to attend this meeting. Thanks to everyone who sent in letters and appeared to testify at the hearing.

The Boulder County Commissioners will hear information about the changes proposed to the Land Use Code Merger Rule - Section 18-121. If your property has been merged you need to be at this hearing! Or at least send a letter - or both.

Has Your Property Been Merged?

What is Boulder County’s Merger Policy?
Boulder County Land Use Code 18-121.B states that adjacent parcels under 35 acres, held in common ownership, and located in the mountainous areas of Boulder County were "merged" as of May 19, 1993. Boulder County adopted this article without notifying or getting the consent of the affected property owners, or actually merging their deeds and tax records. In 1995, Article 18-121 was expanded to include the merging of contiguous parcels located in platted subdivisions throughout Boulder County. The result of these actions is that hundreds of Boulder County landowners have had their property merged without their knowledge or consent.
